Terms of Service

By accessing or using Social Monkey, you agree to these Terms. If you use Social Monkey on behalf of a business or organization, you confirm that you have authority to bind that business or organization to these Terms.

Social Monkey provides tools for business profiles, AI-assisted social content, media management, drafts, scheduling, approvals, customer context, connected accounts, publishing workflows, and related workspace features. Some features may be experimental, unavailable, limited by third-party platform approval, or changed over time.

You are responsible for maintaining the confidentiality of your account, devices, sign-in methods, and authorized users. You are responsible for activity under your account. Tell us promptly if you believe your account or connected platform access has been compromised.

You keep ownership of content you upload, enter, connect, generate, draft, schedule, or publish through Social Monkey, including business information, captions, images, videos, notes, customer records, and connected account data.

You grant Social Monkey a limited license to host, process, display, analyze, transmit, adapt, and use your content as needed to provide the service, including AI-assisted drafting, previews, scheduling, connected account workflows, publishing, support, security, and troubleshooting.

You are responsible for reviewing and approving content before it is published or sent. Social Monkey may help create captions, ideas, hashtags, image prompts, research notes, and schedules, but AI output can be incomplete, inaccurate, outdated, or unsuitable. You must verify claims, offers, pricing, availability, legal statements, regulated content, and any platform-specific requirements before use.

If you connect third-party platforms such as Meta, Facebook, Instagram, Google Business Profile, TikTok, YouTube, LinkedIn, Pinterest, Microsoft, or other services, your use is also governed by those platforms' own terms, policies, permissions, rate limits, review requirements, and account settings. Social Monkey is not endorsed by, sponsored by, certified by, or affiliated with those platforms.

We are not responsible for third-party platform outages, rejected posts, permission changes, API review limits, token expiration, account restrictions, moderation decisions, or changes to third-party services.

You agree not to use Social Monkey to:

• Violate laws, regulations, platform policies, intellectual property rights, privacy rights, or publicity rights.
• Upload, create, schedule, or publish deceptive, abusive, harmful, hateful, harassing, or unlawful content.
• Send spam, manipulate engagement, impersonate others, or misrepresent your affiliation with a person or business.
• Attempt to bypass security controls, access other users' data, overload the service, scrape the app, or reverse engineer non-public parts of the service.
• Use AI features to create content that you know or should know is false, infringing, unsafe, or prohibited by a connected platform.

You are responsible for ensuring that you have the rights and permissions needed to upload and use media. Media storage, duplicate checks, file size limits, preview URLs, and publishing availability may depend on your plan, storage provider limits, connected platform requirements, and technical constraints.

If Social Monkey offers paid plans, subscriptions, usage-based features, trials, or add-ons, the pricing, billing cycle, renewal terms, cancellation options, and refund rules shown at purchase will apply. Unless stated otherwise at checkout, fees are non-refundable except where required by law.

Plans described as unlimited are offered for normal business use. Social Monkey pays third-party AI providers for every request the service makes on your behalf, and we measure that cost per workspace using our own usage records and provider rates.

If a workspace’s measured AI provider cost in a billing period exceeds the amount paid for that workspace’s plan in the same period, we may contact you, limit or suspend AI features for that workspace, require an upgrade, or end the subscription. Where practical we will notify you before limiting access, and our usage measurements will be the basis for any action taken.

This section exists to prevent extreme or automated usage from making a plan unsustainable. It is not intended to restrict ordinary use, and using your full monthly credits at whatever pace you choose is expressly allowed.

Social Monkey, including the software, interface, branding, designs, workflows, and service content, is owned by Social Monkey or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership of the service or permission to use our branding except as needed to use the service.

Our Privacy Policy explains how Social Monkey collects, uses, stores, and shares information. By using Social Monkey, you also agree that your information may be handled as described in the Privacy Policy.

We may update, suspend, discontinue, limit, or change Social Monkey or any feature at any time. We try to keep the service reliable, but we do not guarantee uninterrupted availability, error-free operation, specific publishing outcomes, platform approval, post reach, engagement, leads, bookings, or revenue.

You may stop using Social Monkey at any time. We may suspend or terminate access if we believe you have violated these Terms, created risk for the service or other users, caused legal exposure, failed to pay applicable fees, or used the service in a way that connected platforms or law prohibit.

Social Monkey is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, Social Monkey will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, publishing failures, platform restrictions, or AI output errors.

You agree to defend, indemnify, and hold harmless Social Monkey from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your content, your use of Social Monkey, your connected accounts, your violation of these Terms, or your violation of another person's rights or applicable law.

These Terms are governed by the laws of the State of Illinois and applicable United States law, without regard to conflict-of-law rules. Courts located in Illinois will have exclusive jurisdiction for disputes that are not required to be resolved in another forum by applicable law.

We may update these Terms from time to time. The effective date above shows when this version became effective. If changes are material, we may provide notice through the app, website, or account email when practical. Continued use after changes means you accept the updated Terms.
